Terms of Service
These terms govern your access to and use of the EventSuri platform. Please read them carefully before using our services.
Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and EventSuri ("EventSuri", "we", "us" or "our"), governing your access to and use of the EventSuri website located at eventsuri.com and all related services, applications and tools we provide (collectively, the "Platform").
By accessing or using the Platform in any way, including browsing the website, creating an account, purchasing a ticket or listing an event, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Platform. Continued use of the Platform constitutes ongoing acceptance of these Terms.
You must be at least 18 years of age to use the Platform. If you are between 13 and 17 years of age, you may only use the Platform with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are under 13 years of age, you may not use the Platform.
If you are accessing or using the Platform on behalf of a business, organisation or other legal entity, you represent that you have authority to bind that entity to these Terms, and references to "you" in these Terms include that entity.
Our Services
EventSuri operates an online platform that enables event discovery, ticket purchasing and event management in Kenya and, over time, across Africa. The Platform facilitates transactions and communications between event organisers ("Organisers") and event attendees ("Attendees").
The services available on the Platform include:
- Browsing and discovering events listed by Organisers
- Purchasing tickets to events through the Platform
- Receiving and storing digital tickets for event entry
- Creating and managing an organiser profile and event listings
- Selling tickets to events and managing attendees
- Accessing event analytics and performance data
- Verifying ticket validity at events using QR code scanning
EventSuri acts as a marketplace and technology platform. We are not the organiser or promoter of events listed on the Platform unless explicitly stated. The responsibility for the event, including its delivery, cancellation or postponement, rests with the Organiser.
We reserve the right to modify, suspend or discontinue any part of the Platform at any time with or without notice. We will not be liable to you or any third party for any modification, suspension or discontinuation of the Platform.
Accounts
To access certain features of the Platform, including purchasing tickets and listing events, you must register for an account. When creating an account you agree to provide accurate, current and complete information and to keep that information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@eventsuri.com if you suspect any unauthorised access to or use of your account.
We will not be liable for any loss or damage arising from your failure to protect your account credentials. You may not share your account with or transfer your account to another person.
- Attendee accounts are for individuals who wish to discover and purchase tickets to events.
- Organiser accounts are for individuals, businesses or organisations that wish to list and manage events on the Platform.
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or for any other reason in our sole discretion. Where possible and appropriate, we will notify you before taking such action.
Attendee Rules
When you purchase a ticket through EventSuri, you are purchasing a licence to attend a specific event organised by a third-party Organiser. The ticket is personal to you and is subject to the Organiser's event terms and conditions in addition to these Terms.
- You must present your digital ticket QR code at the event entrance for scanning.
- Tickets must not be resold or transferred without the explicit permission of the Organiser.
- Each ticket is valid for a single use. Once scanned, the QR code is invalidated.
- You are responsible for ensuring you meet any age, identity or other requirements set by the Organiser.
- EventSuri is not responsible for your ability to attend an event due to personal circumstances.
Attempting to counterfeit, duplicate or tamper with tickets is a serious violation of these Terms and may constitute a criminal offence under Kenyan law. Any person found to have done so will have their account permanently suspended.
Organiser Rules
By listing an event on EventSuri, you represent and warrant that you have the legal right and authority to organise and hold the event, and that all information provided in your event listing is accurate, complete and not misleading.
- You are solely responsible for delivering the event as described in your listing.
- You must promptly notify EventSuri and ticket holders of any cancellation, postponement or material change to the event.
- You must obtain all necessary permits, licences and approvals required for your event.
- You must comply with all applicable Kenyan laws and regulations.
- You must have a clear refund policy disclosed in your event listing.
- You may not list events that are illegal, fraudulent or that promote violence, discrimination or other harmful content.
- You must not collect ticket revenue and then fail to hold the event without arranging refunds.
EventSuri reserves the right to approve or reject any event listing at its sole discretion. We may remove events that violate these Terms or that we reasonably believe could harm attendees, third parties or the reputation of the Platform. We will endeavour to notify Organisers of rejection and the reason where possible.
You agree to indemnify and hold EventSuri harmless from any claims, losses, damages or expenses arising from your event, your failure to deliver the event as described, or your violation of these Terms.
Payments and Fees
All prices displayed on the Platform are in Kenyan Shillings (KES) unless otherwise stated. By completing a purchase, you authorise EventSuri to charge the amount specified at checkout using your chosen payment method.
EventSuri currently supports M-Pesa and card payments. Supported payment methods may change from time to time and will be displayed at checkout. By using a payment method, you represent that you are authorised to use it.
EventSuri charges a service fee on certain ticket purchases. The service fee, if applicable, will be clearly displayed during checkout before you confirm your purchase. The service fee is non-refundable except where required by law or as set out in our refunds policy.
Ticket revenue collected by EventSuri on behalf of Organisers is disbursed subject to the payout schedule and minimum payout thresholds set out in the organiser dashboard. EventSuri deducts its commission before disbursing funds. Funds may be withheld pending resolution of disputes, refund claims or compliance concerns.
If a payment fails for any reason, your ticket order will not be confirmed. EventSuri is not responsible for any losses arising from failed payments caused by your payment provider or financial institution.
Refunds
Refund eligibility for event tickets is primarily determined by the Organiser's refund policy, which is disclosed in the event listing. EventSuri does not guarantee refunds for tickets unless the event is cancelled, postponed or materially changed.
If an event is cancelled by the Organiser, ticket holders are entitled to a full refund of the ticket face value. EventSuri service fees may not be refundable. EventSuri will endeavour to process refunds within a reasonable time following confirmation of the cancellation.
If an event is postponed or rescheduled, your ticket will generally remain valid for the new date. If you are unable to attend the new date, please contact the Organiser directly or reach out to EventSuri support for assistance.
EventSuri does not automatically offer refunds for change of mind. Refund eligibility for this reason is at the Organiser's discretion in accordance with the refund policy stated in the event listing.
To request a refund, please contact us at support@eventsuri.com with your order number and reason for the request. We will liaise with the Organiser where required.
Content
Users and Organisers may submit content to the Platform including event descriptions, images, logos and other materials ("User Content"). By submitting User Content, you grant EventSuri a non-exclusive, worldwide, royalty-free licence to use, display, reproduce and distribute your User Content in connection with the operation and promotion of the Platform.
You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not infringe any third party's intellectual property rights, privacy rights or any applicable law.
You must not submit content that:
- Is false, misleading or deceptive
- Infringes any third party's intellectual property rights
- Contains offensive, abusive or discriminatory material
- Promotes illegal activity
- Contains malware, viruses or other harmful code
- Violates any person's privacy rights
EventSuri reserves the right to remove any User Content that violates these standards or these Terms without notice.
Prohibited Conduct
You agree not to engage in any of the following when using the Platform:
- Using the Platform for any unlawful purpose or in violation of any applicable law
- Attempting to gain unauthorised access to any part of the Platform or its systems
- Interfering with or disrupting the Platform or servers or networks connected to the Platform
- Using automated tools, bots or scrapers to access or collect data from the Platform without permission
- Creating fake events, listings or accounts
- Collecting or harvesting personal data about other users without their consent
- Sending unsolicited communications or spam to other users
- Impersonating any person or entity
- Reselling tickets above face value without Organiser permission
- Attempting to circumvent or manipulate the Platform's payment systems
- Engaging in any conduct that damages the reputation of EventSuri or other users
Violation of these prohibitions may result in immediate account termination and, where appropriate, referral to the relevant authorities.
Intellectual Property
The EventSuri Platform, including its design, logo, trademarks, software, text, graphics, interfaces and all other content produced by EventSuri (excluding User Content), is owned by or licensed to EventSuri and is protected by Kenyan and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purposes in accordance with these Terms. Nothing in these Terms transfers any ownership of EventSuri's intellectual property to you.
You may not copy, modify, distribute, sell, sublicense, reverse engineer or create derivative works based on the Platform or its content without our prior written consent.
Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use and protect your personal information.
By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
Disclaimers
The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, EventSuri disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
EventSuri does not warrant that the Platform will be uninterrupted, error-free, secure or free from viruses or other harmful components. We do not warrant the accuracy, completeness or reliability of any content on the Platform, including event listings created by Organisers.
EventSuri is a marketplace platform. We do not endorse, guarantee or take responsibility for the quality, safety, legality or delivery of events listed by third-party Organisers.
Limitation of Liability
To the fullest extent permitted by applicable law, EventSuri, its directors, employees, agents and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including loss of profits, data, goodwill, business or other intangible losses, arising out of or in connection with your use of or inability to use the Platform.
In no event shall EventSuri's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the total amount you paid to EventSuri in the twelve months immediately preceding the event giving rise to the claim, or KES 5,000, whichever is greater.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable Kenyan law, including liability for fraud or fraudulent misrepresentation.
Indemnification
You agree to indemnify, defend and hold harmless EventSuri and its directors, officers, employees, agents and affiliates from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in connection with:
- Your use of or access to the Platform
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any event you organise and list on the Platform
- Any User Content you submit to the Platform
- Any claim by a third party arising from your conduct
Termination
You may close your account at any time by contacting us at support@eventsuri.com. Upon closure, your right to use the Platform will cease immediately.
EventSuri may suspend or terminate your account and access to the Platform at any time if we believe you have violated these Terms, for legal or regulatory reasons, or in our sole discretion. We will endeavour to provide notice where it is reasonable to do so.
Upon termination, provisions of these Terms that by their nature should survive will continue to apply, including sections on intellectual property, disclaimers, limitation of liability and indemnification.
Changes to Terms
EventSuri may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify registered users by email or through the Platform.
Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising from or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
